These Terms and Conditions and Privacy Policy (the "Terms") govern your use of the Emma Earle Art website and your participation in the print waitlist. "Emma Earle Art," "we," "us," and "our" refer to Emma Earle and the Emma Earle Art business. By submitting your information through our website, you agree to these Terms. If you do not agree, please do not join the waitlist.

The waitlist lets you receive updates and early access when prints of our artwork, including The Ten Virgins, become available.

• No purchase or payment. Joining the waitlist is free. It is not an order, reservation, or contract to buy anything.
• No obligation. You are not required to buy anything, and we are not required to sell to you.
• No guarantees. We do not guarantee that prints will be offered, or offered in any particular size, material, quantity, price, or timeframe. Product details shown on the site are previews and may change.
• Founding-edition offers. Any early-access pricing, discounts, or limited editions are offered at our discretion, may be limited in quantity, and may be changed or withdrawn at any time.
• Eligibility. You must be at least 18 years old to join the waitlist.

Information you give us:

• First and last name
• Email address
• Phone number (optional)
• Your print preferences, such as format and size
• Anything else you choose to share in our form, by email, or through social media

Information collected automatically: When you visit our site, we and our service providers may collect basic technical data. This includes your device and browser type, IP address, pages visited, referring website, and the date and time of your visit. We may use cookies and similar tools to collect it.

By submitting your information, you authorize us to store and use it for any lawful business purpose, including to:

• Notify you when prints, preorders, or new artwork become available
• Send you updates, announcements, promotions, offers, and other marketing
• Respond to your questions and provide customer support
• Understand demand, such as which sizes and formats people want
• Plan, develop, and improve our products, website, and business
• Process and fulfill any future orders you choose to place
• Prevent fraud, protect our rights, and comply with legal obligations

By joining the waitlist, you agree that we may contact you using the information you provide, including by email, by social media message, and, if you separately opt in, by text message or phone call. These messages may include marketing and promotional content.

Email. You can unsubscribe at any time using the link at the bottom of any marketing email, or by emailing emmaearleart@gmail.com. We may still send non-marketing messages about any order you place.

Text messages and calls. If you provide your phone number and check the text-message consent box, you agree to receive recurring marketing and informational text messages and calls from Emma Earle Art at that number. These may be sent using automated technology.

• Consent to texts is not a condition of any purchase.
• Message frequency varies.
• Message and data rates may apply.
• Reply STOP at any time to stop receiving texts. Reply HELP for help, or email emmaearleart@gmail.com.
• Carriers are not liable for delayed or undelivered messages.
• You confirm that you are the account holder or authorized user of the phone number you provide.

We do not sell your personal information. We may share it with:

• Service providers who help us run the business, such as website hosting, database, email and text-messaging platforms, payment processors, and print and shipping partners. They may use it only to provide services to us.
• A buyer or successor if Emma Earle Art is sold, merged, or reorganized.
• Authorities or others when required by law, or when needed to protect our rights, safety, or property, or those of others.
• Anyone else, with your consent.

Your information is stored with our third-party service providers, which may be located in the United States or elsewhere. We use reasonable measures to protect it, but no website or storage system is completely secure, and we cannot guarantee its security. We keep your information for as long as you remain on our list, or as long as reasonably needed for our business and legal purposes.

• Unsubscribe from emails using the link in any marketing email.
• Stop texts by replying STOP.
• Request access, correction, or deletion of your information by emailing emmaearleart@gmail.com. We will respond within a reasonable time, subject to any information we must keep by law.

Our site is not directed to children under 13, and we do not knowingly collect their information. If you believe a child has given us information, contact us and we will delete it.

All artwork, images, text, and other content on this site, including The Ten Virgins, are owned by Emma Earle and protected by copyright. You may share links to our site and our official social media posts. You may not copy, reproduce, print, sell, modify, or use our artwork or images for any commercial purpose, or to train AI models, without our written permission. Buying a print does not transfer any copyright or reproduction rights.

Any preorder or purchase you choose to make later will be governed by the terms shown at checkout, including pricing, payment, shipping timelines, returns, and refunds. International shipping availability and rates depend on the destination country. Email emmaearleart@gmail.com for details.

Our site and waitlist are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Emma Earle Art is not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or the waitlist. Our total liability for any claim related to the waitlist will not exceed $50. Some jurisdictions do not allow certain limitations, so these may not apply to you.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah County, Utah.

We may update these Terms at any time by posting the revised version on this page with a new effective date. Your continued participation in the waitlist after changes are posted means you accept them.
